   Please read this End-User License Agreement (“Terms”, “Terms and Conditions”) carefully before using the Eyecharm mobile application, provided by WhichWin.

   Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service. purchases If you wish to purchase any product or service made available through the Service (“Go Premium”), you won’t be asked any personal data. You will be billed by App Store and Google Play directly.

   1. Grant of License

   WhichWin grants you a non-exclusive, non-transferable, limited license to use the Eyecharm application in accordance with the terms and conditions of this Agreement.

   2. Fees and Subscriptions

   If you choose to purchase a subscription, you will be billed through the App Store or Google Play directly. WhichWin will not ask for any personal data during the purchase process.

   3. Intellectual Property

   The Eyecharm application, including its content, features, and design, is owned by WhichWin and is protected by intellectual property laws. You acknowledge and agree that all rights, title, and interest in the Service are and shall remain the exclusive property of WhichWin.

   4. Privacy

   WhichWin respects your privacy and handles your personal data in accordance with applicable privacy laws and regulations. For more information on how we collect, use, and protect your personal data, please refer to our Privacy Policy.

   5. Limitation of Liability

   To the extent permitted by law, WhichWin shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Service or this Agreement.

   WhichWin reserves the right to terminate or suspend your access to the Service at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the terms of this Agreement.

   WhichWin reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is material, we will make reasonable efforts to provide notice in advance. Your continued use of the Service after the revisions become effective constitutes your acceptance of the updated Agreement.
